These policies govern Nordyx game server hosting, support, billing, acceptable service use, service credits, and official customer communication.

Terms of Service

1. Acceptance of Terms

By accessing or using our game server hosting services, website, billing area, control panel, or support systems, you agree to comply with and be bound by these terms and conditions. Your use of the services constitutes your acceptance of these terms. If you do not agree with any part of these terms, you should not use the services.

These terms also include our Service Use Policy, Privacy Policy, Service Level Agreement, Third-Party Communication Policy, and any product-specific terms shown during checkout. If you are a consumer, nothing in these terms limits mandatory rights that apply under Danish law, EU consumer law, data protection law, or other non-waivable law.

2. Service Description

We provide game server hosting services that allow users to deploy, configure, and manage multiplayer game servers on rented infrastructure. Our services may include server resources, storage, bandwidth allocation, DDoS mitigation, game control panel access, backups where included, automated provisioning, and technical support.

We strive to maintain a high level of service quality and uptime, but occasional maintenance, datacenter issues, hardware failures, software problems, migrations, security events, DDoS attacks, and unforeseen issues may arise. You rent access to a hosted service and do not obtain ownership, tenancy, or exclusive rights in any physical server, node, datacenter equipment, network route, IP address, or supplier infrastructure.

3. User Responsibilities

Users are responsible for the content they upload, their game server configuration, server administrators, mods, plugins, worlds, maps, files, passwords, player activity, and compliance with all applicable laws and regulations. You must not use our services for illegal, abusive, malicious, or disruptive activity, including but not limited to malware distribution, hacking, phishing, DDoS activity, spam, fraud, or infringement of intellectual property rights.

You are responsible for maintaining the security of your login credentials and for keeping independent backups of important data. Included backups, where available, are a convenience feature and should not be treated as your only copy of important worlds, saves, configs, or files.

4. Payment and Billing

Users agree to pay the fees associated with the chosen hosting plan. Game server hosting is billed monthly unless a written agreement states otherwise. Renewal invoices are generated through our billing system and must be paid by the invoice due date. We do not offer yearly, semi-annual, or longer billing periods for the game server products covered by these terms.

If you choose a subscription-based payment method, your monthly service may renew automatically unless canceled before renewal. Failure to make timely payments may result in suspension, termination, loss of access, or deletion after the applicable grace period.

5. Refunds, 24-hour Money Back Guarantee, and Downtime Credits

Nordyx may offer a 24-hour money-back guarantee for eligible first-time game server purchases. To request it, you must open an official support ticket within 24 hours of the service activation time. Requests outside that window are not eligible for the voluntary guarantee. The guarantee does not apply to abuse, fraud, chargeback activity, violations of these terms, custom work, add-ons, third-party license costs, or accounts created to repeatedly use refund offers.

If a dedicated server, node, datacenter, upstream provider, network route, storage device, or other infrastructure component fails or becomes unavailable due to a breakdown or unforeseen incident, Nordyx will work to restore service as reasonably possible. Repairs, replacement hardware, datacenter access, upstream escalation, and migration can take time.

For verified qualifying downtime, the remedy is a service credit applied to the affected service's next monthly invoice. The credit is calculated from the affected service's monthly recurring fee and the verified downtime during that billing month. If the affected service is down for an entire billing month, the next monthly renewal for that affected service may be credited up to 100%.

Downtime credits are not direct cash refunds and are not transferable. Credits do not cover indirect loss, lost revenue, lost players, lost donations, advertising costs, staff time, third-party software costs, or unrelated services. Where mandatory law requires a different remedy, mandatory law controls.

6. Termination

We reserve the right to suspend or terminate services for violations of these terms, non-payment, abuse, security risk, excessive resource use, illegal activity, hostile conduct toward staff, false account information, chargeback abuse, infrastructure protection, provider requirements, legal compliance, or another legitimate operational reason needed to protect the platform, our customers, our providers, or our reputation.

If your account or service is terminated due to violations, you may lose access to your game server, content, files, backups, and data. We may also take legal action or recover fees if your actions harm our servers, network, suppliers, customers, staff, or reputation.

You should contact Nordyx support before opening a payment dispute, PayPal case, card chargeback, or similar third-party claim. Fraudulent, abusive, duplicate, or bad-faith disputes may result in suspension, termination, account closure, recovery of fees, and refusal of future service. This does not prevent you from exercising mandatory legal rights or using lawful complaint channels.

7. Limitation of Liability

To the maximum extent permitted by law, Nordyx is not liable for damages or losses resulting from the use or inability to use our hosting services, including indirect, incidental, consequential, special, punitive, business, reputational, lost profit, lost player, or lost data damages arising from the use or misuse of our services.

While we strive to provide reliable and secure hosting, you acknowledge that no online service is completely immune to vulnerabilities, outages, hardware failure, datacenter problems, supplier issues, attacks, or unforeseen incidents, and you use our services at your own risk. Nothing in these terms excludes liability for fraud, intentional misconduct, gross negligence, death or personal injury where applicable, statutory liability, or remedies that cannot legally be excluded under Danish or EU law.

8. Changes to Terms

We may update these terms from time to time for future use of the services, legal compliance, security, operational requirements, provider requirements, product changes, or service changes. We will notify you of significant changes by email, account notice, or by prominently displaying a notice on our website where appropriate. If applicable law requires a specific notice period or affirmative acceptance, Nordyx will follow that requirement.

Continued use of the services after an effective update constitutes acceptance of the updated terms to the extent permitted by law. Changes will not remove mandatory rights you already have under Danish law, EU consumer law, data protection law, payment law, or other non-waivable law.

By paying for the next billing month, you agree to renew your subscription for an additional monthly term. By completing payment, you confirm that you have read, understood, and accepted the current Terms of Service, Privacy Policy, Service Use Policy, Service Level Agreement, and Third-Party Communication, including any notified updates, amendments, or changes that apply to the renewed billing period. Unless cancelled before the next renewal date, your subscription will continue on a monthly basis and the applicable monthly fee will be charged in advance.

9. Official Support, Third-Party Communication, and Special Pricing

Support requests, refund requests, cancellation requests, downtime credit requests, legal notices, billing disputes, and account ownership matters must be handled through the official Nordyx support ticket system, billing area, or another official channel we identify in writing.

Messages or comments on Discord, SMS, social media, community chats, game servers, direct messages, voice calls, or other third-party platforms are informal unless Nordyx confirms the same matter through an official ticket, invoice, account notice, or written agreement. To the maximum extent permitted by law, informal comments do not amend these terms, waive rights, approve refunds, create uptime promises, authorize chargebacks, change billing, or bind Nordyx to custom support commitments.

Nordyx may offer different pricing, discounts, sponsorships, credits, legacy rates, group arrangements, clan arrangements, promotional offers, reseller pricing, or individual commercial terms on a case-by-case basis. Different customers, groups, or clans may pay different prices or receive different benefits. Unless a mandatory law says otherwise, one customer's pricing or benefit does not entitle another customer to the same pricing, benefit, refund, credit, or offer.

Where a price is shown during checkout, the checkout price and invoice terms control for that order. If Nordyx ever uses automated personalised pricing based on customer behaviour or profiling, we will provide the disclosure required by applicable consumer law.

10. Infrastructure Transfer and Migration Rights

Because the service is rented hosting, Nordyx may move, migrate, transfer, reprovision, or replace the underlying server, node, IP address, location, upstream provider, supplier, or datacenter when reasonably necessary for security, reliability, compliance, capacity, commercial continuity, provider requirements, or operational reasons.

We may use employees, contractors, affiliates, infrastructure providers, datacenter operators, control panel vendors, and other service providers to deliver, repair, migrate, or support services, subject to applicable data protection obligations.

11. Order of Precedence, Severability, and No Waiver

If there is a conflict between these terms and product-specific terms shown during checkout, the product-specific terms control for that product unless mandatory law requires otherwise. If there is a conflict between an official invoice and informal communication, the official invoice, ticket, account notice, or written agreement controls.

If any part of these terms is found invalid, unlawful, unfair, or unenforceable, that part will be limited or removed only to the minimum extent required, and the remaining parts will continue to apply to the maximum extent permitted by law. Nordyx failing to enforce a right immediately does not waive that right or prevent later enforcement.

These terms are intended to be read in a manner that is valid, transparent, and enforceable. They do not limit court rights, complaint rights, statutory remedies, consumer rights, data protection rights, or other rights that cannot be waived by contract.

Privacy

1. Controller

Nordyx, as identified in the billing area, invoice, or official website contact information, is the controller for personal data processed in connection with account registration, orders, billing, support, fraud prevention, service delivery, and website operation. You can contact us through the official Nordyx support system or the contact method listed on our website.

2. Personal data we process

We may process account details, names, email addresses, billing addresses, country, phone numbers, IP addresses, login events, support tickets, invoice data, payment status, service configuration data, control panel identifiers, abuse reports, server logs, and communications with support.

3. Why we process data

We process data to create and manage accounts, provision services, issue invoices, collect payment, prevent fraud and abuse, provide support, investigate incidents, protect infrastructure, comply with law, maintain security, send service notices, and improve service reliability.

4. Legal bases

Depending on the activity, processing may be based on contract performance, legal obligation, legitimate interests, consent, or establishment and defence of legal claims. Consent-based processing can be withdrawn where applicable.

5. Payment data

Payments may be handled by third-party processors such as PayPal, card processors, banks, or integrated payment gateways. Nordyx does not need to store full card numbers when a payment provider can process them directly. Payment providers process data under their own terms and privacy notices.

6. Subprocessors and suppliers

We may use hosting providers, datacenters, control panel vendors, billing software, email services, payment processors, fraud tools, analytics providers, support tools, DDoS mitigation providers, and contractors to operate the service. Data is shared only where reasonably necessary for service delivery, security, compliance, or support.

7. International transfers

Where personal data is transferred outside the European Economic Area, Nordyx will use an appropriate transfer mechanism where required, such as adequacy decisions, Standard Contractual Clauses, or another lawful safeguard.

8. Retention

We keep data for as long as needed for account operation, billing, accounting, tax compliance, dispute handling, fraud prevention, security, legal claims, and service delivery. Backups and logs may persist for a limited period before deletion or rotation.

9. Customer rights

Depending on the circumstances, you may have rights to access, rectify, erase, restrict, object to processing, data portability, and complain to a supervisory authority. In Denmark, the supervisory authority is Datatilsynet.

10. Security

We use reasonable technical and organisational measures to protect personal data. No hosting platform, network, or online service can be guaranteed completely secure, and customers must protect their own passwords, control panel access, admin accounts, and server credentials.

11. Cookies

The website, client area, payment flows, and support systems may use cookies or similar technologies for login sessions, security, cart operation, preferences, analytics, or fraud prevention. Non-essential cookies should be controlled by a compliant consent mechanism where required.

Strictly necessary cookies and storage may be used for login sessions, shopping carts, security, fraud prevention, service operation, and remembering privacy choices. Analytics, marketing, advertising, social embeds, or similar non-essential technologies should remain disabled unless the user has consented. Users can change or withdraw non-essential cookie consent through Cookie settings.

Where a browser sends a recognized Global Privacy Control signal, Nordyx treats it as an opt-out of marketing or sale/share style tracking where applicable.

Service Use

Service Use Policy

1. Scope

This Service Use Policy applies to all Nordyx services, including game servers, control panel access, files, plugins, mods, databases, network traffic, support systems, and customer accounts.

2. Illegal or harmful use

You may not use Nordyx services for illegal activity, fraud, malware, botnets, phishing, credential theft, scams, intellectual property infringement, threats, harassment, unlawful hate content, exploitation of minors, or activity that harms Nordyx, other customers, networks, providers, or the public.

3. Network abuse

You may not initiate, coordinate, proxy, amplify, or knowingly facilitate DDoS attacks, port scanning, vulnerability scanning without permission, spam, reflection attacks, brute-force activity, unauthorized access, packet floods, or traffic intended to disrupt services.

4. Game server conduct

You are responsible for activity on your game server. You must manage administrators, plugins, mods, uploaded files, user-generated content, and player behaviour. Servers that repeatedly attract attacks, abuse complaints, malware, or provider complaints may be suspended or migrated.

5. Resource abuse

You may not use services for crypto mining, unrelated compute workloads, file dumping, mass storage, proxying, VPN resale, scraping, unauthorized relays, or workloads outside the intended game server purpose unless Nordyx approves it in writing.

6. Content and intellectual property

You must have the rights needed for content, mods, plugins, maps, files, brands, and software you upload or distribute. We may remove or restrict content in response to valid complaints, legal requests, publisher requirements, or infrastructure risk.

7. Enforcement

Nordyx may investigate, suspend, null-route, filter, migrate, restrict, terminate, or report services where necessary to protect infrastructure, comply with law, respond to provider requirements, or enforce this policy. Emergency enforcement may occur without notice.

SLA

Service Level Agreement

1. Service target

Nordyx targets high availability for game server services, but no online hosting service can guarantee uninterrupted operation. Hardware, datacenters, upstream carriers, DDoS events, software, customer configuration, emergency maintenance, and third-party dependencies can affect availability.

2. Qualifying downtime

Qualifying downtime means verified unavailability of the affected Nordyx-hosted service caused by Nordyx-controlled infrastructure or a qualifying infrastructure failure. Downtime is measured using Nordyx monitoring, provider information, support records, and technical evidence.

3. Exclusions

Downtime does not include planned maintenance, emergency security work, customer-caused issues, unpaid invoices, suspension for abuse or non-payment, game software bugs, mod/plugin failure, customer configuration errors, compromised credentials, force majeure, publisher outages, third-party software outages, or attacks being actively mitigated where the server remains reasonably protected.

4. Credit calculation

For verified qualifying downtime, Nordyx may issue a service credit for the affected service. The credit is calculated from the monthly recurring fee for that service and the verified downtime in the billing month. Credits are capped at 100% of the affected service's monthly fee.

For instance, if an affected monthly service is unavailable for half of the billing month due to qualifying downtime, the maximum credit is 50% of that service's monthly recurring fee. If the affected service is unavailable for the entire billing month, the next monthly invoice for that affected service may be credited up to 100%.

5. No direct downtime refunds

Downtime remedies are issued as service credits on the next invoice, not direct cash refunds, unless mandatory law requires otherwise. Credits apply only to the affected service and do not apply to unrelated services, add-ons, setup fees, payment fees, taxes, third-party software, loss of income, or consequential loss.

6. Credit requests

To request a service credit, open a support ticket with the affected service, approximate downtime window, symptoms, and any relevant evidence. Nordyx may deny requests that are incomplete, abusive, outside the qualifying scope, caused by the customer, or unsupported by technical records.

7. Repair and migration

If hardware, datacenter equipment, storage, power, network, or another infrastructure dependency fails, Nordyx may repair, replace, migrate, reroute, or reprovision the service. Repair timelines can depend on supplier response, datacenter access, parts availability, security review, backup integrity, and the size of the affected data.

Communication

Third-Party Communication Policy

1. Official Support Channels

Nordyx uses the official support ticket system, billing area, account notices, invoices, and official website contact methods for account-specific support, billing, cancellations, refund requests, downtime credit requests, legal notices, complaints, and service decisions.

If you need Nordyx to act on something, create a support ticket or use the official billing area. A message sent only through Discord, SMS, social media, a community server, a personal direct message, a voice call, or another third-party platform may be missed, delayed, incomplete, or handled informally.

2. Informal Third-Party Channels

Nordyx may maintain or participate in Discord servers, social media pages, community chats, SMS conversations, game servers, or other third-party platforms. Those channels are for general communication, community updates, quick guidance, or convenience. They are not the official system of record for account-specific support unless Nordyx confirms otherwise through an official channel.

To the maximum extent permitted by law, statements on third-party platforms do not create binding promises, contract amendments, refund approvals, cancellation confirmations, uptime guarantees, service credits, migration commitments, price locks, custom support duties, or waivers of Nordyx rights unless the same commitment is confirmed in an official ticket, invoice, account notice, or written agreement from Nordyx.

3. Support Records and Evidence

The official ticket system is the primary support record Nordyx will rely on when reviewing account history, refund eligibility, service credits, downtime reports, abuse reports, cancellations, ownership checks, and billing disputes. Customers should not rely on informal third-party messages as proof that a support request was opened, accepted, escalated, approved, or completed.

This policy does not prevent Nordyx from keeping or using third-party communication records where reasonably necessary for abuse prevention, account security, dispute handling, legal compliance, moderation, fraud prevention, or protection of Nordyx, customers, staff, providers, or the public.

4. Emergency and Public Notices

Nordyx may post outage updates, maintenance notices, or incident updates on Discord, social media, a status page, or other public channels for convenience. Those updates are informational and may be incomplete while an incident is being investigated. Official remedies, credits, support decisions, and account-specific conclusions must still be handled through the official support or billing systems.

5. Case-by-Case Pricing and Benefits

Nordyx may offer different pricing, discounts, coupons, sponsorships, promotional benefits, goodwill credits, legacy rates, group or clan arrangements, reseller pricing, partner terms, or individual commercial arrangements on a case-by-case basis.

Customers, clans, groups, communities, partners, or individual users may therefore pay different prices or receive different benefits for similar or comparable services. These differences may depend on timing, promotion availability, service history, volume, location, sponsorship value, migration arrangements, legacy plans, manual approval, commercial relationship, or operational needs.

Receiving a different price or benefit is not a guarantee that the same price or benefit will continue, be repeated, or be offered to another customer. Another customer's discount, sponsorship, credit, or special arrangement does not entitle you to a matching price, refund, credit, benefit, or change to your invoice unless Nordyx agrees in an official channel or mandatory law requires otherwise.

6. Consumer Transparency

The price presented during checkout, together with the invoice and product description, controls the price for that order. Nordyx will not intentionally hide mandatory fees at checkout. If applicable law requires disclosure of personalised pricing, automated decision-making, taxes, fees, or other pricing information, Nordyx will provide the required disclosure before purchase.

Nothing in this policy limits mandatory rights that apply under Danish law, EU consumer law, data protection law, or other non-waivable law.
